These Membership Terms (Terms) govern the application for Bricks Need Mortar Membership (Membership) and your continued Membership status. It is your responsibility to review these Terms prior to submitting your application for a Membership. By applying for Membership you agree to be bound by these Terms. We reserve the right to amend these Terms at any time and will provide the most recent version on our website.
Throughout these Terms, the terms “Bricks Need Mortar”, “we”, “us” and “our” refer to Bricks Need Mortar and its associated entities, and “you” refers to the individual purchasing a Membership.
1. APPLICATION FOR MEMBERSHIP
1.1. Our current Membership descriptions, tiers, benefits, and pricing will always be stated on our website located at https://bricks-need-mortar.com (Website).
1.2. All applications for Membership must be made by filling out the form on our Website. This will create a membership account for you.
1.3. All information you provide during the application process must be accurate and complete, and it is your responsibility to keep your details up to date.
1.4. We will only process completed applications, and reserve the right to reject an application for any reason.
1.5. It is your responsibility to maintain the confidentiality of any password you create for accessing your account.
1.6. We will send you a confirmation email on receipt of payment of the applicable Membership Fee. Your Membership is deemed accepted on the day you receive the email.
1.7 Once your Membership is accepted by us, these Terms, the Terms of Service (available at https://futurewomen.com/terms-of-service/) and our Privacy Policy (available at https://bricks-need-mortar.com/privacy-policy (as each amended from time to time) will govern your continued Membership of FW and use of our Services.
2. MEMBERSHIP FEES
2.1. The Membership Fee may be paid in various ways depending on the type of Membership purchased, including:
(a) An upfront annual payment via credit card on our Website (if you are purchasing an Annual Membership);
(b) An ongoing monthly direct debit, payable monthly in advance (if you are purchasing a Monthly Membership) or
(c) other payment terms as set out in any specific third-party partner offer promoted on the Website and purchased by eligible members (3P Offer Membership).
2.2. The Membership Fees are as advertised on our Website at the time of purchase, and Bricks Need Mortar in its sole discretion reserves the right to change any Membership Fees on at least one month’s written notice to existing members. Any special offer or discount offered, such as (but not limited to) a 3P Offer Membership may be withdrawn or changed without notice.
2.3 Once paid, Membership Fees are non-refundable. If you purchase an Annual Membership, your fees are non-refundable if you wish to cancel your Annual Membership early. If you purchase a Monthly Membership, you will be liable to pay those fees due only up to the date of cancellation as set out in clause 3.2 below.
2.4 All prices include GST unless otherwise specified.
3. AUTO RENEWAL AND TERMINATION
3.1. If you pay annually, your Annual Membership will be automatically renewed each year, on the anniversary of the date you joined Bricks Need Mortar (Anniversary) unless you wish to terminate your Membership. If you wish to terminate your Annual Membership, you must give us notice at least 5 days prior to the Anniversary by logging into your account settings and selecting ‘Cancel’. If we do not receive notification from you, your Annual Membership shall be auto-renewed and the applicable Membership Fee payable. You shall be charged for the entire year during which cancellation is requested and no refund for any months remaining will be provided.
3.2 If you pay month by month, your Monthly Membership will continue month by month until such time you wish to terminate by logging into your account settings and selecting ‘Cancel’ at least seven (7) days before your next billing cycle. Cancellation of a Monthly Membership will be effective immediately. You shall be charged for the entire billing cycle during which cancellation is requested and no refund for any part-month remaining will be provided.
3.3 For auto-renewals, the applicable Membership Fee for the forthcoming year/month will be charged to the same credit card you used on joining, unless you specify otherwise.
4. GENERAL MEMBERSHIP TERMS
4.1 By signing up and being granted Bricks Need Mortar Membership, you will have access to a range of content, special offers, a private Bricks Need Mortar Facebook Group, and other benefits (Member Content) available via the Website, Facebook, and through direct communications between us and You, as set out in more detail in the Membership benefits specified on our Website (and varying depending on the type of Membership you purchase). You will also be able to access general content on the Website which is subject to our Terms of Service available at https://futurewomen.com/terms-of-service/.
4.2 All Member Content is subject to copyright law and the Terms of Service apply equally to Member Content as to any other Content accessed on or through the Website or Facebook Group. Members should seek permission from Bricks Need Mortar or the relevant copyright holder before sharing or distributing any Member Content accessed through the Website, the Facebook Group or any other services provided by us. In the event of failure to seek and be granted permission to share or distribute any Member Content, Bricks Need Mortar has the right to terminate your Membership and take further action as may be appropriate to protect any and all intellectual property rights Bricks Need Mortar has in the Member Content.
4.3 Bricks Need Mortar reserves the right to change the features, content or services related to any Membership without notice to you in order to improve the quality of the Membership offered to you or for any other reason, as its sole discretion.
4.4 Membership is to be used by a sole individual (pursuant to the provided login credentials) and is non-transferable. Membership benefits including logins, access to content and services are linked to a specific user, and cannot be shared with other non-Users. Bricks Need Mortar shall monitor the number of devices used to access a Membership and breach of these Terms may result in Bricks Need Mortar revoking your Membership. In the event of Membership being revoked due to breach of this clause, no refund shall be provided for any Membership Fees you may have already paid.
5. PRIVACY
5.1. Personal Information provided by you during the Membership application process and throughout the duration of your Membership will be held and dealt with in accordance with our Privacy Policy, which is available on our Website.
5.2. Without limiting our Privacy Policy, you consent to:
- Your name and any other optional parts of your profile provided by you (including job title, company, personal bio and image if supplied) being made accessible to other Members on our Website; and;
- Receiving commercial emails from us and our approved third-party providers.
You may change the level of information made available on our Website and opt-out of emails by logging into your account settings and editing your preferences, or by notifying us directly.
6. MEMBER CONDUCT
6.1. Bricks Need Mortar does not take any responsibility or liability whatsoever for disputes between Members or third parties on our Website, Facebook Group or otherwise connected with our provision of Membership services to you.
6.2. There are sections of our Website that are accessible to both registered Members and general website visitors (FW Site Visitors). These sections may include Member Directory listings and the ability to send direct messages to others. We will only make your Member profile data publicly available with prior written permission from you. When accessing those sections of our Website, you must not:
- harass, abuse or harm other Members or FW Site Visitors; send spam or other un-welcomed communication to other Members or FW Site Visitors;
- act in an unlawful, abusive, defamatory, discriminatory or otherwise objectionable manner; or
- infringe the intellectual property rights of others, including those of Bricks Need Mortar, Members, FW Site Visitors or third parties.
6.3. Your use of, and conduct on, our Website, Facebook Group and Services will be otherwise subject to the Terms of Service available at https://futurewomen.com/terms-of-service/.
6.4 We may revoke your Membership for any reason, including for breach of these Terms, the Terms of Service, the Community Guidelines, Facebook Terms of Use or for bringing Bricks Need Mortar into disrepute.
7. THIRD PARTY CONTENT/SERVICES/EVENTS
7.1 Services and marketing material may be offered to Members including events, promotional offers and general advertising by our partners and advertisers. These Services may have additional terms that apply as set by the applicable third party, and Brick Needs Mortar claims no responsibility or liability over the content, accuracy or availability of these.
8. LIMITATION OF LIABILITY
8.1. To the extent permitted by law, we exclude all conditions and warranties relating to your Membership.
8.2. Where our liability cannot be excluded, such as in relation to Consumer Guarantees under the Australian Consumer Law or other prescribed terms under legislation, our liability for breach is limited to the Membership Fees paid by you.
9. MISCELLANEOUS
9.1. These Terms shall in respects be governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts in New South Wales to determine any matter or dispute which arises under these Terms.
9.2. If any provision of these Terms is deemed invalid or unenforceable, all or part of that provision will be severed from the Terms and will not affect the enforceability of the remaining provisions of the Terms.
9.3. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under the Terms shall not constitute a waiver of such right.
9.4. These Terms, in conjunction with the Terms of Service available at https://futurewomen.com/terms-of-service/ and the Privacy Policy available at https://bricks-need-mortar.com/privacy-policyconstitute the entire agreement between Bricks Need Mortar and you in relation to Membership.
